Promotional Period and Promoter

Emergency Services Superannuation Board (ABN 28 161 296 741) (ESSSuper) of Level 16 / 140 William St, Melbourne VIC 3000 is the Promoter (the Promoter). The Agent is Evolved Insights Pty Ltd ABN 91 141 289 705 of Level 3, 176 Wellington Parade, East Melbourne VIC 3002.

1. Table 1 details the starting and closing dates for the promotion.

2. Information on how to enter and the prizes forms part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. Entry is only open to ESSSuper members who are residents of Victoria, Australia and aged 18 years or over. Employees of the Promoter, its associated companies and agencies and their immediate families are ineligible to enter.

4. To enter, you must a) be invited to participate in one of five ESSSuper Member Experience Research Surveys (Funds In / Disposition / Member Service Centre / Member Education Consultant / Financial Planning) b) complete the survey in full and c) provide your contact details where requested.

5. Multiple entries are not allowed.

6. Participants must be existing members of ESSSuper at the time the competition is drawn and reside in Victoria.

7. Participants are responsible for ensuring that their details entered during registration are correct.

8. After the draw, the prize winners' names only will be published on the website theevolvedgroup.com/winners on the following dates:

9. Any entry submitted after 11:59pm (Melbourne time) Saturday 30 June 2024 will not be eligible to participate in this promotion.

10. The draw will be held on 2:00pm (Melbourne time) at Level 2, 405 Little Bourke St, Melbourne, Victoria 3000 on the following dates:

11. The Promoter's decision in relation to all aspects of this competition will be final and binding on all participants. No correspondence will be entered into.

Prize

12. Each draw contains five (5) prizes: one (1) AUD$500 Mastercard gift card and five (5) AUD$50 Mastercard gift cards.

13. The total value of the prize pool is $3,000.

14. The winners will be contacted by email and phone. Delivery of the prize will be coordinated with the winner (depending on location).

15. Prizes are non-refundable, non-transferable, not redeemable and not exchangeable in whole or part for cash or services.

16. Participants are responsible for keeping their member account details up to date. If the winner of a prize cannot be contacted within three (3) months after the conducted draw, the winner will be deemed to have forfeited any entitlement to the prize, and a new winner will be drawn three (3) months after the close of the unclaimed monthly prize draw period at 2:00pm (Melbourne time) at same location as the original draws as are necessary to distribute the prize, subject to any written directions given by any relevant authority. Winners of unclaimed prizes will be notified in writing and their name and state/territory of residence will be published only on the website theevolvedgroup.com/winners within seven business days of the redraw date.

17. The draw will be conducted by an Agent appointed by the Promoter.

18. By entering this competition, an entrant agrees to receive marketing material from ESSSuper in relation to their superannuation held with ESSSuper.

General Terms and Conditions

19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents or associated agencies) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion or the prize offered as part of the promotion.

20. If for any reason this competition is not capable of running as planned due to any cause beyond the control of the Promoter that corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, at its sole discretion to the fullest extent permitted by law, to (a) disqualify any participant who is deemed by the Promoter to tamper with the process of this promotion; and/or (b) subject to any written direction given by a regulatory authority to modify, suspend, cancel or terminate the promotion, as appropriate.

21. The Promoter is not responsible for any lost, late, incorrect, inaccurate, incomprehensible or ineligible information, either caused by participants or for any of the equipment or programming associated with or utilised in the promotion or for any technical error, or any combination thereof that may occur in the course of the administration of the competition, including any omission, interruption, deletion, defect, delay in operation or transmission; communications line or telephone, mobile or satellite network failure; theft or destruction; or unauthorised access to or alteration of entries.

22. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside the Promoter's reasonable control, the Promoter is entitled to cancel, terminate, modify or suspend the promotion, subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the promotion, if applicable.

23. The law implies various conditions and warranties which might apply to the Promoter supplying goods or services to the participant. The Promoter excludes all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.

24. The Promoter may terminate or cancel the participant's entry in the competition immediately at the Promoter's reasonable discretion or if the participant breaches any of his or her obligations under these conditions.

25. The participant releases and agrees to keep the Promoter indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by the Promoter, its directors, employees, agents and representatives arising out of the participant's entry in the competition, the use of the prize by the participant or any claim by a third party arising from an act or omission by the participant.

26. The Promoter is not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.

27. These conditions constitute the entire agreement between the participant and the Promoter as to its subject matter. By entering the competition, the participant accepts that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in Victoria, in accordance with the laws in force in Victoria from time to time.
